USCIS H-1B Adjudication Slowdown Update

United States Citizenship & Immigration Service (USCIS) is experiencing a slowdown in adjudications with regard to cap-subject H-1B cases for the Fiscal Year 2011.

On August 25, 2010, USCIS Service Center Operations (SCOPS) provided an update stating that they are aware that both the Vermont Service Center (VSC) and California Service Center (CSC) are outside published processing times and that they are working as fast as they can to catch up.  Currently, VSC is working on petitions receipted in April while CSC is working on petitions receipted in late April and early May.  USCIS indicated that they received a very large number of petitions in April and May, but that receipts fell off dramatically thereafter, so processing times should improve once examiners worked through the April and May backlog.

USCIS warned that there will be another slowdown, potentially, when examiners get to petitions submitted in July and August, as there was a spike in petitions submitted by large employers in advance of the new H and L fee rules going into effect.
