New H-1B and L-1 Fee for Some Companies

On 8/13/2010, President Obama signed a bill into law providing $600 million dollars for “emergency supplemental appropriations for border security.”  The enforcement resources will be paid for in part by a new filing fee charged to certain companies filing H-1B and L-1 petitions.

Specifically, the bill raises filing fees for L visas by $2,250 and H-1B visas by $2,000 for companies/petitioners that have more than 50 employees in the U.S. with more than 50 percent of their employees on L or H-1B visas. 

The filing fee increase will begin once implemented by the Department of Homeland Security.  The filing fee increase ends on September 30, 2014.
